REQUIREMENTS FOR REGISTRATION
Entering the Community of Mybazar constitutes acceptance of the conditions ruling the entire relationships’ system explained in this agreement as well as in the Ethical Code.
Except as explicitly stated otherwise, the introduction of incidental modifications in the fruition of the service will be ruled by this agreement, according to wich the user recognizes and accepts the service being offered “as it is” and “as available”; Mybazar takes no responsibility on this matter.

ACCOUNT AND PASSWORD
At the end of the registering procedure the new user is given an Account (ID) and a reserved Password to get free access to the service.
These tools are strictly personal, and, for all the activities linked with their use, the same user remains the only and sole responsible for every harmful or detrimental consequence he would bring to the site or to others due to their loss, subtraction or compromission, being perfectly aware that these identifying elements constitute the only verification of his own authentication for the access to the site. All the activities carried on using the ID and the Password involve the automatic attribution of the operations made and the requests effected to the owner of the same ID and Password, without exceptions. For this matter, every user is obliged to communicate to Mybazar every non-authorized use of his own Password or registering Account.      

PERSONAL DETAILS AND RULES OF CONDUCT
The personal details given with the registration and the carrying on of respective activities on Mybazar website must be up to date, complete and true, and mustn’t be in contrast with provisions of the law and/or regulations in force on the specifical matters of false declarations, copyrights or rights of ownership by third persons, right of privacy and right of protection of personal details and their use.   
They musn’t, as well, contain for no reason words obscene, offensive, discriminating or contrary to the common morals, or however persecuted by the law.
The registration to the site and the relating acceptance of the rules and the Ethical Code, constitutes an explicit authorization to the publishing of the respective advertisements and descriptions, and gives to Mybazar the irrevocable permission for a free and transferable use of copyrights and other rights of intellectual ownership, including the rights related with the image, in relation with the personal details.
These informations will be managed and treated according to the rules of the Privacy Policy.
The registration to the site constitutes an engagement not to use, copy, enter or violate any mechanism, software, process or anything else meant to interfere with its functionality, or to trouble anyhow the normal activity of the service in general or to its users.
The user knows and recognizes that Mybazar doesn't preventively inspect the contents, but reserverves to itself the discretion to refuse or remove any content wich could violate its rules or its ethical code, being the users themselves in charge of every responsibility in this matter.
About the classes of objects admitted for  bartering, you can read the proper section of the site (objects not allowed for bartering), where there’s a list of the objects wich, for their nature, use or destination, are not allowed for bartering, or are just allowed partially and/or to a limited extent.
In case of doubt, Mybazar reserves to itself the faculty not to authorize the exposition of a specific object.In case of inobservance of the above, Mybazar, at its own discretional evaluation, may suspend, temporarily or definitively, the Bazar. 

FEES AND SERVICES
The fees required to buy the ownership of a bazar are to be considered as an annual canon to use the exchanging platform provided by Mybazar for its registered users.
The bazars differentiate on their quantitative capacity and on the possibility to make use of particular features and additional services.

The payment of the rates doesn’t give to the owner of the bazar the exclusive right on his web pages, where Mybazar can, at its own discretion and without asking permission in advance, insert third parts’ advertisements.

“MYBAZAR” EXCHANGING CONTEXT 
The service offered by Mybazar doesn’t include any activity of mediation, or similar, between the users.
Mybazar isn’t involved at all in the exchanging among the users made on the website, and it engages itself to arrange a mere precautionary activity of control in the moment of the registration and the purchase of the ownership of a bazar, respecting the current rules and the dispositions reported in this agreement and in the Ethical Code as well.   
Being Mybazar not involved in the bartering negotiations, carried on in autonomy by the users, they engage themselves to keep Mybazar out of any responsibility, direct or indirect, upon the managing and the resolution of  controversies of any kind wich may arise in connection with the use of the website.
The website gives its registered users the possibility to ‘expose’ their own objects in a virtual window (bazar) arranged for this purpose.  
The way to select, confirm the interest and then exchanging the objects between the bazars’ owners remains exclusively in charge of the same users, having them the possibility to carry on any operation anytime and from any place with an internet connection, in complete decisional and operative autonomy.
Mybazar doesn’t take any responsibility upon the truthfulness of the informations given or upon their correspondence with the objects to be bartered. It doesn’t take any responsibility as well upon the quality, safety, conformity, lawfulness of the objects involved in the barter deal. It can’t, as well, verify the actual correspondence of the personal declarations made by its users in the act of the registration with their effective ability to carry on barter deals.  
It can’t, as well, guarantee the truthfulness of the personal details declared by its users in the act of the registration, and so it doesn’t answer for possible damages caused by wrong or fallacious informations given by any of them.  To be able to proceed to the barter of his objects, the owners of the bazars must have access to the same object they want to barter and must describe precisely and thruthfully their basic and essential features, both positive and negative, in order to emphasize their qualities and to guarantee, at the same time, the people who could be interested in the exchange. 
The listing of the objects in the proper categories pre-arranged in the website, meant only to catalogue them, may, in case, be disposed by the same website.
To guarantee to its users a greater certainty of the respect of the laws, Mybazar reserverves to itself the discretion, following its unobjectionable judgement, to stop, suspend or delete the account of anyone wich would engage in a fraudolent activity or wich would not respect the rules of behaviour reported in the agreement as well as in the Ethical Code. 

THE BAZARS
The only fixed context in Mybazar for exchanging objects is its community of users (Bazar's Community).   
The bazar is a virtual window where the single user, paying an annual fee, is given the possibility to expose its objects, freely visible and exchangeable by the other users in the community.The analitic regulation on the bazars’ working, in the different provided classes, is explained in the  correspondent pages Evry class of bazar has a differentiated expositive dressing, with the additional options, expositive and promotional, typical of the same class.    

THE BARTER DEAL’S WORKING ON “Mybazar”
The working of the barter deals on Mybazar is based on the complete autonomy on the contacts among the members of the Bazar’s Community, where every user has his own bazar, dressed on the purpose to expose and promote his own objects to be bartered. Every user can proceed, among the Bazar’s Community, with searching objects in wich he’s interested, that, if singled out, he can point out to the respective bazars; that’s the way to make a ‘bartering proposal’.     
The bazar contacted by the interested user can, after having considered its opportuneness, decide to accept or not the proposal received; if he does, he can proceed to his own ‘bartering counter-proposal’, confirming the interest for one or more objects in the proposing bazar’s window.
If the agreement upon the bartering of the respective objects is reached, either the bazars will have to confirm the final bartering engagement, due to make  the agreement effective.

BAZAR "B"
After having received a “confirmation of interest” in an own object, coming from the Bazar "A":
1. Goes over the related window, to find if any exchange usefulness exists with any of the objects exposed in it.
2. If the searching has a positive result, he proceeds with his  “bartering counter-proposal”, selecting in his turn the respective object singled out for the exchange. 

BAZAR "A"  
once received the “bartering counter-proposal” from the Bazar "B" referring to one of his objects exposed in the window: he decides either to proceed or not with the final confirmation of the bartering engagement due to make the exchange effective and leading to the delivery of the objects.

RELIABILITY PROFILE
The reliability profile has the only purpose to control the behaviour of the Bazar’s Community’s  users in the bartering operations.
To help in keeping the exchanging context agreeble and open to the judgements of the single users of the Community, and to guarantee to the same users the possibility to operate in a safe and reliable environment, the interested bazars are given the possibility to write a ‘reliability’ remark on the ethical behaviour adopted during the carrying on of the negotiations, at the end of a barter deal.   The remark must concern merely the carrying on of the negotiations, and it must express with the utmost truthfulness and objectivity a comprehensive judgement on the reliabilty of the bazars.  
 
RULES AND VALUATION OF THE RELIABILITY PROFILE
The reliability remark can be released only at the natural end of the exchanging operations and delivering of the objects, between the bartering bazars, in a context of reciprocity.
The only remarks taken into consideration will be those wich concern the ethical behaviour adopted during and at the end of the negotiations. Following the remark given, and in application of the same, the bazar will have to express a final valuation, as a comprehensive judgement, as reported here:   
• VERY BAD
• INADEQUATE
• ADEQUATE 
• GOOD
• VERY GOOD

The "very bad” valuation can be given only if an object is not delivered after the bazars have enterered into a bartering engagement, considering that this, if verifiyed by Mybazar, may lead to the immediate suspension of the bazar.
The remarks valuated "inadequate” and "adequate" provide a negative point (-1) and a positive point (+1) respectively.
When the total level of -3 is reached, Mybazar may order the suspension of the bazar, due to the reiterated difficulty of the bazar in respecting the ethical rules of behaviour of the Bazar’s Community.
The "good" valuation permits to expose in your own bazar’s window a “silver bazar” .
The "very good" valuation, in its turn, permits to expose a “golden bazar” to be affixed in your window, as a particular award for merit.
At the reaching of 5 golden bazars, due to the peculiar reliability of the bazar and to the model ethical behaviour adopted in the Bazar’s Community, the affixing of a “platinum bazar” is provided.   

SUSPENSION AND EXCLUSION
In addition to the cases provided by the law, or to the non-fulfilment of the obligations related to this agreement, the bazar may be suspended or deleted from the website in case of veryfied violations about the authenticity of the personal details given for the use of the service, and as well for violations causing a damage to Mybazar.
If, exercising the users their freedom of speech, assertions wich in the single’s opinion are wrong or wich damage one’s own image is expressed, even if they are deleted, the user recognizes, accepting this agreement, that Mybazar doesn’t exert any right to control or verify the same assertions, and so it can’t take any responsibility upon it and will not answer to any request of compensation.
For that matter Mybazar reserves to itself, anyway, in applcation of the principle of non-discrimination, the right to remove, following its unobjectionable judgement, any assertion or comment considered not to be suitable to the proper ethical behaviour in the Community.
The user, as well, recognizes and accepts that Mybazar, in order to protect its community, may, at its own and exclusive discretion, delete the user’s account and password and stop him from using the service, and as well remove or refuse informative and/or descriptive contents considered to be not suitable, and recognizes that Mybazar can’t anyway be held responsible before him or any other user for stopping the access to the service.

RULES OF MYBAZAR
All the informations, reportings and warnings included in the web pages as well as in the respective access links, contained in the specific parts of the site, divided by the arguments they deal with, constitute an integrating and substantial part of this agreement, accepted by the users when they register. Possible modifications or integrations brought to this agreement, in its whole, communicated in the proper sections of the website, become effective the the day after their publication.

RIGHTS OF PROPERTY
The user acknowledges that the trademark, service and software of Mybazar are protected by the law on the matter of intellectual and/or industrial property, and engages himself not to copy, modify, spread or use anyway all that is created and/or produced, entirely or partially, from them.
Mybazar, for the bare purposes allowed for the utilization of the service, provides a personal and non-transferable licence to the registered user to use the software, only and exclusively through itself.  

RESPONSIBILITY RESTRICTION
All the users of Mybazar must respect punctually the laws, national and international, according to their country of origin, and as well this agreement, wich is ruled and put under the the italian law.
With the registration to the website, the user accepts and assents to the same agreement as well as to the ethical code of Mybazar, releasing it from any request of compensation coming from a violation of contractual ties, legal provisions, or rights of third parts.
Mybazar can’t assure that the service will fulfil the user’s demands, that it will be provided  without breaks or errors, that the results obtained using it will be thruthful and reliable and will fulfil the user’s expectations, or that incidental defects or errors in the software will be corrected.

OTHERS
Mybazar will use, seen the particular case, the e-mail or the ordinary mail, at the referring addresses given at the registration, for any personal communication.
If any situation coming from elements objectively not foreseeable occurs, Mybazar can’t secure a continuous and unbroken access to the site and its services.
This agreement is valid and effective even if some of the clauses contained in it reveal to be, for any reason, null, or annulable, or ineffective.
The non-exercise of an own right provided by the law or by this agreement, or by any other normative source, doesn’t mean in any case waiving the same right.

ACCEPTANCE OF THE AGREEMENT
The user declares, according to the law, that he/she has read and approves what’s provided  in this agreement, in particulr referring to the items 1 (Requirements for registration), 2 (Personal details and rules of conduct), 3 (Fees and services), 9 (Suspension and exclusion), 10 (Rules of mybazar), 11 (Rights of property), 12 (Responsibility restriction), 13 (Others).
